Certified Pre-Owned Limited Warranty

I. LIMITED WARRANTY
One-Year Limited Warranty

ElectraCraft, Inc. warrants to the original purchaser only that each ElectraCraft Boat that has been pre-owned and has been checked and certified by ElectraCraft, including each part and accessory thereof, is free from defects in material or workmanship. This warranty expires one year from the date of purchase.

II. PURCHASERíS EXCLUSIVE REMEDY
As purchaserís exclusive remedy, ElectraCraft will correct at its own expense any failure of any part or accessory of the boat to conform to the relevant warranty with either new or used replacement parts. If ElectraCraft is unable to repair the boat to conform to the relevant warranty after a reasonable number of attempts, ElectraCraft will replace the part or accessory. These remedies are the purchaserís only remedies for breach of warranty.

If the purchaser discovers a defect in the boat covered by the foregoing limited warranties, the purchaser must promptly notify ElectraCraft in writing. Upon receipt of such written notification, ElectraCraft will arrange an appointment between an Authorized ElectraCraft Service Technician and the purchaser. An Authorized ElectraCraft Service Technician or another technician approved by ElectraCraft in advance must perform all repair work under this limited warranty.

Unless authorized by ElectraCraft in writing, purchaser will be responsible for the costs of transporting the boat to and from the ElectraCraft factory or an Authorized ElectraCraft Service Center and for the travel expenses of the Authorized ElectraCraft Service Technician. III. DISCLAIMER OF IMPLIED WARRANTIES
THE FOREGOING WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ELECTRACRAFT HEREBY EXPLICITLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IV. PURCHASERíS RESPONSIBILITIES
Purchaserís responsibilities include (a) providing proof of purchase; (b) filling out and mail the warranty information card to ElectraCraft within ten (10) days of purchase; and (c) providing reasonable care and maintenance. Purchaserís failure to exercise these obligations will invalidate this limited warranty.

V. LIMITATIONS AND EXCLUSIONS
This limited warranty does not apply to (a) any boat, including any part or accessory thereof, that has been abused, misused, altered, neglected, improperly trailered, overloaded, involved in an accident or overpowered according to factory recommended horsepower; (b) any boat used outside of the United States; or (c) any boat used for commercial or rental purposes. With respect to a boat used for commercial or rental purposes, this limited warranty is limited to thirty (30) days from the date of purchase on the boat and all parts and accessories thereof.

ElectraCraft does not warrant (a) any boat, components, or parts not manufactured by ElectraCraft; (b) defects caused by failure to provide a suitable environment for the boat; (c) damage caused by use of the boat for purposes other than those for which it was designed; (d) damage caused by disasters such as fire, flood, wind, and lightning; (e) damage caused by unauthorized alterations, attachments or modifications to the boat; (f) damage caused by repair work by anyone other than an Authorized ElectraCraft Service Technician; (g) damage caused by any other abuse or misuse of the boat.

VI. LIMITATION OF REMEDIES

In no event will ElectraCraft be liable for any special, incidental, or consequential damages based on breach of warranty, breach of contract, negligence, strict tort, or any other legal theory. Damages that ElectraCraft will not be responsible for include, but are not limited to, loss of profits, loss of savings or revenue, loss of use of the boat or any associated equipment, cost of capital, cost of any substitute equipment, facilities, or services, downtime, the claims of third parties, including customers, and injury to property. This limitation does not apply to damages caused by breach of the warranty of title and against claims of infringements or to claims for personal injury.

VII. TIME LIMIT FOR BRINGING SUIT
Any action for breach of warranty must be commenced within 12 months of purchaserís discovery of any defect in the boat covered by the foregoing warranties.

VIII. NO OTHER WARRANTIES
Unless modified in a writing signed by both parties, the foregoing warranties are understood to represent the complete and exclusive warranties provided by ElectraCraft on the boat, superseding all oral or written prior agreements and all other communications between the parties relating to the subject matter of this agreement, including statements made by salespersons. No employee of ElectraCraft or any other party is authorized to make any warranty in addition to the foregoing warranties.

IX. TRANSFERABILITY
This limited warranty is non-transferable.

X. ADDITIONAL RIGHTS UNDER STATE LAW
This limited warranty gives purchaser certain rights. Purchaser may have greater rights under state law. Some states do not allow limitations on how long a limited warranty can last or the limitations of incidental or consequential damages. In such states, these limitations may not apply to purchaser.
